END USER LICENSE AGREEMENT

This agreement should be read in its entirety. Use of our software acknowledges the terms set forth.

The software is being licensed to you by 52DECK.com for your private personal use only on "AS IS" basis.

This agreement governs the 52DECK.com ("Servers"), all 52DECK.com applications ("Client") and all intellectual property contained therein ("Software").

The Server software runs from a remote computer owned and operated by 52DECK.com. The end user will not have access to the Server software, except through the means provided via the operation of the Client software. The Client software will be made available to the user, under the terms outlined in this agreement. The User will identify himself/herself to the software via a unique License Number ("License") known only to the User.

The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

1. GRANT OF LICENSE. 52DECK.com grants the User the right to install and run the Client software on any computer for which it was designed. The User may only install the software on (1) computer. Licenses are not transferable and may not be sold or distributed. 52DECK.com reserves the right to invalidate any license that is believed to have been shared, copied or otherwise compromised.

2. NO WARRANTIES. 52DECK.com disclaims any warranty for the Software. The Software and any related documentation is provided "AS IS" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. 52DECK.com reserves the right to alter the software to include or drop certain functionality. Features may be limited to the uses of specific logs. The entire risk arising out of use or performance of the Software remains with the user. Any screen shots displayed on the 52DECK.COM website may be out-dated from current software design. FREE trial versions are available for inspection before purchase.

3. PROHIBITED USES. The User may not attempt to modify, decompile, reverse-engineer or dissassemble the software in any way.

4. LIMITATION OF LIABILITY. Under no circumstances, including negligence, shall 52DECK.com be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use (or misuse) of the Software.

5. SECURITY. The User agrees that he/she is solely responsible for all use of any 52DECK.com Software through his/her license number. Licenses are issued for use by ONE user on ONE machine at a time.

6. PERSONAL USE. Commercial use of 52DECK.com Software is strictly forbidden. The user agrees that his/her use of the software is in a personal (and not professional) capacity.

8. TERMINATION. Without prejudice to any other rights, 52DECK.com may terminate this END USER LICENSE AGREEMENT if you fail to comply with the terms and conditions of this agreement. In such event, you must destroy all of your copies of the software.

9. 52DECK.com reserves the right to change the license agreement and the terms and conditions at any time with or without notice. Such amendments will become effective immediately upon being posted at 52DECK.com. This license is governed by the laws of Massachusetts.

10. REFUNDS. 30 days after purchase or after a license has been activated refunds will not be issued under any circumstance. All software provides a fully functional nag-delay-version to determine compatibility and functionality before purchase.

10a. STOP PAYMENT or CHARGE REVERSALS. All users must download and test the software prior to purchase to insure that the software performs as expected. Any check payment or credit card charge that is reversed will be pursued for repayment.

11. ONLINE DISCUSSION FORUMS. Discussion forums may be provided for legitimate support, discussion and chat. Forums are for respectful discussion only. Those who use the forums for flaming, threats or other inappropriate discussion will be banned from the forums without question.
